An election petition tribunal appeal panel sitting in Ibadan, capital of Oyo state has declared Rauf Aregbesola as the legitimate winner of the 2007 gubernatorial election in Osun state.
The court in its sitting today decided four major reliefs in favour of Aregbesola, The reliefs includes the cancellation of elections in 10 local governments in the states.
Mr Aregbesola, had urged the court to set aside the decision of the lower tribunal which adopted the declaration of Oyinlola, arguing that the panel failed to consider the avalanche of evidence brought by the petitioner before giving judgement.
He particularly made reference to the votes cast at the Boripe and Atakunmosa local government areas of the state where the number of registered voters were far less than the number declared for the PDP candidate.
He added that the fact that INEC failed to call evidence to defend the allegation that the election was marred by high irregularities in 10 local governments challenged by the appellant means the commission did agree with Aregbesola’s position, arguing that the votes cast in the affected areas should be cancelled to ensure justice.
But, Yusuf Ali, Oyinlola’s lead counsel, said the appellant has failed to prove his case, saying it is not enough for a plaintiff to dump evidence on the court.
